An Act Strengthening the Cost Certification Process of 40B

Much attention has been paid to recent investigations by the Inspector General into the cost certification process of 40B. Although the Department of Housing and Community Development has responded to the Inspector’s concerns through changes to the guidelines governing 40B, some of those changes should be given the strength of law in order to best enhance the cost certification process. This bill defines related party transactions, instructs DHCD to return excess profits to the municipality where the development is cited, establishes that all documents submitted by developers to the DHCD are submitted under the pains and penalties of perjury, and sets a penalty that will be assessed should it be determined that the developer who does not submit a cost certification. |
